1. Agreement to Terms

By accessing or using WildLand Access (“the Platform,” “we,” “us,” or “our”) at wildlandaccess.com, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use this Platform. These Terms apply to all visitors, users, hunters, landowners, brokers, outfitters, and any other party who accesses the Platform.

2. Description of Service

WildLand Access is an online directory and marketplace that connects hunters (“Hunters”) with landowners, brokers, outfitters, and agencies (“Listers”) who offer hunting land leases, day access passes, guided hunts, and public land information across the United States.

WildLand Access is a platform intermediary only. We do not own, operate, manage, or control any of the hunting properties listed on the Platform. We do not employ hunters or Listers, and we are not a party to any lease, access agreement, or hunting arrangement made between Hunters and Listers.

3. Eligibility

You must be at least 18 years of age to create an account, submit a listing, or complete any transaction on this Platform. By using the Platform, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

4. User Accounts

4.1 Account Registration

To submit a listing or access certain features, you must register for an account. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

4.2 Account Termination

WildLand Access reserves the right to suspend or terminate any account at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, or is otherwise objectionable at our sole discretion.

5. Lister Responsibilities

If you submit a listing to the Platform as a landowner, broker, outfitter, or agency, you agree to the following:

  • Accuracy: All information in your listing — including acreage, location, game availability, pricing, access type, and amenities — must be truthful, accurate, and not misleading.
  • Legal Authority: You represent that you have the legal right to offer the described access or lease and that the property is not subject to any restriction, easement, or encumbrance that would prevent such use.
  • Compliance with Law: Your listing and any resulting hunting activities must comply with all applicable federal, state, and local laws, including hunting regulations, licensing requirements, and property laws.
  • Liability: You, as the Lister, are solely responsible for the safety of your property and any Hunters who access it under arrangements made through this Platform. You agree to indemnify and hold harmless WildLand Access from any claims arising from a Hunter’s use of your property.
  • Insurance: We strongly recommend that all Listers carry appropriate landowner, farm, or recreational liability insurance. WildLand Access does not provide insurance of any kind.
  • No Misrepresentation: Listings may not contain false, deceptive, or fraudulent information. Violating listings will be removed and the associated account terminated.

6. Hunter Responsibilities

If you use the Platform to search for or contact Listers as a Hunter, you agree to the following:

  • Licensing: You are solely responsible for obtaining all required hunting licenses, tags, permits, and stamps required by your state and the state where you will be hunting, prior to entering any property.
  • Assumption of Risk: Hunting is an inherently dangerous activity. By accessing any property found through this Platform, you voluntarily assume all risks associated with hunting, including but not limited to injury, death, property damage, and wildlife encounters.
  • Respect for Property: You agree to treat all properties with care, comply with the specific rules set by the Lister, leave no trace, close all gates, and abide by all posted signage.
  • Compliance with Law: You agree to comply with all applicable hunting laws, regulations, seasons, bag limits, and weapon restrictions for the state and property in question.
  • Direct Arrangements: Any lease, access agreement, payment, or other arrangement you enter into with a Lister is directly between you and that Lister. WildLand Access is not a party to that agreement.

7. Payments and Fees

7.1 Listing Fees

WildLand Access charges Listers fees to publish listings on the Platform. Fee amounts, plan types, and billing cycles are described on our pricing page and are subject to change with notice.

7.2 Payment Processing

Payments are processed through third-party payment processors including PayPal and Stripe. By making a payment, you agree to those processors’ terms of service. WildLand Access does not store credit card or banking information.

7.3 Refund Policy

Listing fees are generally non-refundable once a listing has been published. If you believe you were charged in error, please contact us within 7 days at [email protected]. Refunds are issued at our sole discretion. We do not mediate or issue refunds for direct payment disputes between Hunters and Listers.

8. Prohibited Content and Conduct

The following are strictly prohibited on the Platform:

  • Listings for properties you do not have legal authority to offer
  • False, misleading, or fraudulent listing information
  • Content that is defamatory, harassing, threatening, obscene, or discriminatory
  • Listings that violate any local, state, or federal law
  • Scraping, crawling, or automated data collection from the Platform
  • Attempting to circumvent the Platform’s payment system by arranging off-platform transactions to avoid fees
  • Posting contact information in listing descriptions to direct users away from the Platform
  • Impersonating another person, business, or entity

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WILDLAND ACCESS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY LISTING CONTENT.

WILDLAND ACCESS IS NOT RESPONSIBLE FOR THE CONDUCT, SAFETY, OR ACTIONS OF ANY LISTER OR HUNTER. WE DO NOT ENDORSE ANY SPECIFIC LISTING, PROPERTY, OR USER.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WILDLAND ACCESS AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF REVENUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless WildLand Access, its owners, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Platform; (b) any listing you submit; (c) your violation of these Terms; (d) any hunting activity or property access arranged through the Platform; or (e) any injury or damage to a third party caused by you.

12. Intellectual Property

All content on the Platform created by WildLand Access — including the site design, logo, text, graphics, and software — is owned by or licensed to WildLand Access and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

Listers retain ownership of photos and content they submit in their listings but grant WildLand Access a non-exclusive, royalty-free license to display, reproduce, and promote that content on the Platform and in marketing materials.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Third-Party Links and Services

The Platform may contain links to third-party websites or services. These links are provided for convenience only. WildLand Access does not endorse and is not responsible for any third-party content, products, services, or privacy practices.

15. Modifications to Terms

WildLand Access reserves the right to update or modify these Terms at any time. We will post the revised Terms on this page with an updated effective date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Idaho, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Platform that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to a jury trial or class action proceeding.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WildLand Access regarding your use of the Platform and supersede all prior agreements, representations, or understandings.
